Who is obliged to carry out the inspection according to DGUV Regulation 3?
Every employer is legally obliged to ensure the safety and health of its employees at work. This includes the safe condition of electrical systems and equipment. The legal basis for this can be found in Section 3 Paragraph 1 of the Occupational Safety and Health Act (ArbSchG), supplemented by the Industrial Safety Ordinance (BetrSichV), the Technical Rules for Industrial Safety (TRBS) and the DGUV Regulation 3 (formerly BGV A3).
To prevent accidents involving electrical equipment, DGUV Regulation 3 stipulates that employers must have all portable and stationary electrical systems and devices regularly inspected by a qualified electrician. These inspections primarily serve to Personal and fire protection, but also the preservation of business assets.
A lack of proof of inspection can not only jeopardize insurance coverage in the event of a claim, but can also result in criminal prosecution (Section 26 of the German Works Safety Ordinance). For this reason, comprehensive documentation of the inspections performed is essential.
Insurance companies are increasingly demanding evidence of regular safety inspections. Some insurers grant additional inspections after VdS guidelines (increased fire protection requirements) even cheaper premiums.

before first commissioning as well as
after modifications or repairs
be checked by a qualified electrician or under their direction and supervision.
